Physicians Payments Sunshine Act

Apparently one of the provisions of the Affordable Health Care Act is to make available to the general public the perks, gifts, etc. that physicians are getting from the pharmaceutical industry and medical device manufacturers. So that beginning in 2013 (Sept.) one will be able to check a data base to see if his/her doctor is taking perks from the pharmaceutical or medical device industries in exchange for prescribing their drugs or using the devices.

Drug representatives have access to pharmacy records to find out how much of their drugs are being prescribed by various physicians. I once witnessed one such exchange.  The doctor’s receptionist asked for additional samples of a particular drug of the company’s representative.  This request was denied because the pharmacy records showed that the doctor was not prescribing sufficient amounts of the particular drug.
